Introduction By accessing and using QurbanAfrica.com, you agree to be bound by the following Terms & Conditions. This website is owned and operated by FAKT Impex Inc. (Registration No. LL18894), a company incorporated under the Labuan Companies Act 1990, Malaysia. FAKT Impex Inc. reserves the right to update these terms at any time.

1. The Service Model (Wakalah)

Qurban Africa provides Qurbani, Aqiqah, and Sadaqah services through an international network of partners. By placing an order, you appoint the Company as your Wakil (Agent) to procure, sacrifice, and distribute the livestock on your behalf. You acknowledge that once the slaughter has been executed in accordance with Shariah guidelines, the service is considered fully rendered, irreversible, and “consumed.”

2. Booking & Registration

  • Automated Confirmation: Orders are confirmed instantly upon successful processing through our secure gateways (PayPal/Stripe).

  • Registration of Name: The donor must provide the “Nominated Name” for the sacrifice at the time of order to ensure the Niyyah (intention) is correctly recorded.

  • Correction Deadline: Any corrections to the Nominated Name must be submitted no later than 48 hours prior to the first day of Eid al-Adha. We cannot guarantee changes after this window due to synchronized field logistics.

3. Payment & Corporate Security

  • Corporate Processing: All transactions are processed by FAKT Impex Inc.

  • Security: We do not store credit card details. All processing is handled by PCI-compliant partners via SSL encryption.

  • Bank Fees: FAKT Impex Inc. is not liable for “International Transaction Fees” or “Currency Conversion Spreads” charged by your personal bank or card issuer.

4. Pricing & Animal Specifications

  • Market Fluctuations: Prices are subject to change based on local market conditions in Africa. Once an order is paid, the price is locked.

  • Shariah Standards: All animals meet age and health requirements for a valid sacrifice and are inspected by local Imams.

  • Biological Variation: Animals are living entities; exact weights, colors, and horn shapes will naturally vary.

  • Substitution: The Company reserves the right to substitute an animal with one of equal or greater value to ensure the religious obligation is met in cases of local unavailability.

5. Execution & Shariah Compliance

  • Timing: Qurbani is performed after the local Eid Salah during the designated days of Eid al-Adha.

  • Supervision: All sacrifices are supervised by Local Imams to ensure the recitation of Tasmiah (Allah’s name), humane handling, and no stunning (where local laws permit).

6. Meat Distribution Policy

  • Charitable Focus: Our primary mission is feeding the poor (orphans, rural communities, and refugees) in Africa.

  • No Customer Delivery: As an international aid service, meat is distributed locally to beneficiaries and is not available for delivery to the donor.

7. Proof of Sacrifice (PPS Policy)

  • Evidence: We strive to provide Personalized Proof of Sacrifice (PPS) videos.

  • Logistical Limits: You acknowledge that technical or logistical delays in rural Africa (internet outages/slaughterhouse restrictions) do not invalidate the religious service. In such cases, a Certificate of Completion and collective distribution data serve as official proof.

8. Cancellation & Refund Policy

  • Non-Refundable Window: Due to advance livestock procurement, cancellations are only accepted up to 7 days prior to Eid al-Adha.

  • Processing Fees: Approved refunds are for the net amount received. PayPal/Stripe transaction fees are non-refundable as they are retained by the processors.

  • Timeline: Refunds take 7–21 working days to reach the original payment source.

9. Limitation of Liability (Force Majeure)

FAKT Impex Inc. shall not be held liable for delays or failures caused by “Acts of God,” including extreme weather (floods), government-mandated livestock lockdowns, local disease outbreaks, or civil unrest. In such cases, we will fulfill the sacrifice in the nearest viable region to ensure your religious duty is completed.

10. Communication & Privacy

By using this service, you consent to receive updates via WhatsApp, Email, and SMS. Your data is handled in accordance with our Privacy Policy and international data protection standards (GDPR/PDPA).

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the Laws of Labuan, Malaysia. Any legal disputes shall be subject to the exclusive jurisdiction of the courts of Labuan/Malaysia.
